Terms and Conditions
Terms governing the use of our platform and services
Welcome to the Platform (as defined below) managed by Zemangat, thank you for using and accessing services through the Platform. The terms and conditions for using the Platform stated on this page ("Terms and Conditions") govern your access to the Platform and the use of all features in it ("Features") developed by Us, PT. Zemangat Anak Bangsa ("Zemangat" or "We").
By accessing the Platform, you declare that you have read, understood and agreed to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, then you are not permitted to access the Platform or use the Features. These Terms and Conditions can be considered as a master agreement that serves as a reference for regulating other terms and conditions including but not limited to privacy policies or other provisions that may be made by Us from time to time, and by binding yourself to these Terms and Conditions, you declare that you are subject to the derivatives of these Terms and Conditions. The invalidity of other terms and conditions will not cause these Terms and Conditions to become invalid, invalid, and/or unenforceable.
By agreeing to these Terms and Conditions, you are considered capable according to Indonesian law and the law in the applicable jurisdiction. If you are not legally capable (including but not limited to minors, those under guardianship, or unauthorized representatives) and are not accompanied by and do not obtain consent from a person who is considered capable of performing legal acts when accessing the Platform, then you are fully responsible for everything you do on the Platform, including but not limited to activities you do with other parties using the Platform. If you act as an employee, agent, or attorney and act for and on behalf of other individuals, organizations, business entities, legal entities, or other institutions, you hereby declare and warrant that you are an authorized party to represent that party, where these Terms and Conditions will bind the party you represent.
Definitions
Account
means as defined in Article 3.1
You
means every visitor and/or user (including Authorized Users), whether individual or business entity or legal entity, whether registered or not registered on the Platform, who accesses and/or uses the Platform and its Features.
Employee
means every person who works in your company, including also prospective employees who are undergoing the recruitment process in your company.
Data
means any data relating to identity, contact, profile, behavior on the Platform, Employee Data, and data related to your personal information, including also data related to your company, which can be identified either directly or indirectly, that you enter into the Platform.
Employee Data
means data that specifically refers to each Employee.
Working Day
means days outside Saturday, Sunday, national holidays, or days determined as holidays by the Indonesian government, where Banks operate commercially.
Applicable Law
means every national law, local provincial, municipal or other law, institutional regulations, decisions, constitution, decisions, rules, binding government policies, and statutes in the Republic of Indonesia.
Platform
means cloud-based sites and applications that function as human resources information systems in the form of web-app and/or mobile, as well as other sites and/or applications owned by Zemangat that can be created and developed by Zemangat from time to time.
About Zemangat
We are a limited liability company that creates, manages, and develops a Platform that functions as a means of organizing Employee Data and managing that data according to the Features we provide on the Platform.
It needs to be understood that the services provided by Zemangat through the Platform are to help you in organizing Employee Data and managing that data according to the features we provide on the Platform, so that every implementation of provisions or policies related to your personnel management, Employee Data, and agreements with Employees become your full responsibility. Therefore, you are advised to pay attention to every provision of employment agreements/other agreements with each Employee, company regulations, and/or collective labor agreements in your company, and to enter all related data accurately into the Platform.
You need to understand that we in providing services through the Platform cannot in any circumstances be considered as advice in running your business activities, so in using services on the Platform you are advised to always pay attention and adjust their use to your business activity strategies and needs.
We reserve the right at any time to change, delete, reduce, add and/or update Features available on the Platform. Your continued use of the Platform will be considered as consent to changes, deletions, reductions, additions and/or updates to Features.
Account Terms
- To be able to access and use the Features available on the Platform optimally, you must create an account ("Account") on Our Platform by registering your business entity or legal entity in the system available on the Platform by including the requested Data.
- You are required to fill in Data and Employee Data completely, accurately, up-to-date, not containing misleading information, and honestly on the Account page as determined by Us. We are not responsible for consequences that occur if there are Features that do not function properly, incompatibility in service delivery, or inappropriate data processing results through Features due to information you provide that is inaccurate or incomplete.
- You are fully responsible for the security and confidentiality of Your Account, including but not limited to passwords, tokens, or other credentials used to access the Account. All activities carried out through Your Account are considered as activities carried out by you yourself.
- You are required to immediately notify Us if there is suspected misuse of Your Account by other parties. We are not responsible for losses arising from misuse of Your Account that is not reported to Us.
User Rights and Obligations
- Use the Platform only for lawful and legitimate purposes.
- Not misuse the Platform for fraud, infringement of third-party rights, or unlawful activities.
- Maintain the security of account access data.
- Provide accurate, truthful, and non-misleading information.
Zemangat's Rights and Obligations
- Provide the Platform and Features in accordance with technical capabilities and internal policies.
- Maintain, repair, update, or modify the Platform and Features at any time.
- Restrict or terminate User access if misuse, legal violations, or breaches of these Terms are suspected.
- Manage User Data in accordance with the Privacy Policy.
Services and Limitations
- The Platform is generally accessible at all times, except during technical issues, maintenance, or force majeure events.
- Zemangat does not guarantee that the Platform will always be free of disruptions or technical errors.
- Zemangat is not liable for losses arising from disruptions, errors, or misuse of the Platform.
Intellectual Property
All intellectual property rights related to the Platform and Features, including code, design, logos, and other content, are fully owned by Zemangat. Users are not permitted to copy, duplicate, modify, or distribute without prior written consent from Zemangat.
Liability and Indemnity
- Users are fully responsible for all actions taken while using the Platform.
- Users agree to indemnify and hold Zemangat harmless from any claims, demands, losses, or expenses arising from violations of these Terms or misuse of the Platform.
Amendments to Terms
Zemangat reserves the right to amend or update these Terms at any time. Changes will be announced through the Platform. By continuing to use the Platform after changes become effective, Users are deemed to have accepted the updated Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising shall first be settled amicably. If no resolution is reached, disputes will be resolved through the courts within the jurisdiction of Indonesia.
